There Are Four Common Ways How To Hold Title In Hawaii

Are you planning to purchase property in Maui, Hawaii? Before moving forward, it is important to consider how the ownership will be registered. Options may include ownership alone, jointly with your spouse, children, or additional partners. To assist you in this process, here is a list of methods for property title-holding in the state of Hawaii.

How to Hold Title

When purchasing property, you will be asked to read and/or sign various documents pertaining to how taxes are paid and what escrow forms must be filed. This is a mountain of documents supplied courtesy of a Hawaii title company. If the title is to be held under a corporation or LLC, it is advised to consult a lawyer for the best course of action. Otherwise, there are multiple available options for basic purchase transactions.

Option 1: Tenants by the Entirety

Tenancy by the entirety is a specific joint tenancy between a lawfully married couple or reciprocal beneficiaries that places ownership of the property in both tenants with equal, undivided rights to the entirety of the property. In the event of one tenant's passing, the other will take complete control of the property without the need for probate, thus excluding heirs and creditors of the deceased tenant.

Unlike a joint tenancy, no tenant can assign their share or force a partition without the permission of the other tenant. A mutual agreement, divorce, the ending of the reciprocal beneficiary relationship, or a joint conveyance may only sever this tenancy.

Option 2: Tenancy in Common

Tenancy in common is an arrangement of shared property ownership between two or more individuals in which each person has an equal or potentially unequal stake in the whole asset. Each of the tenants is allowed to access the property to the extent of their respective shares as long as this does not restrict the rights of the other tenants. In cases where the conveyance document does not indicate the size of the share, it is assumed that each co-tenant holds an equal share. In contrast to a joint tenancy, no tenant in common has the right of survivorship; any of them can sell their portion without the consent of the others.

Option 3: Tenancy in Severalty

Ownership of a property as Tenancy in Severalty is vested in a single individual, with the presumption that all shares are equal. This type of tenancy is also known as Several Tenancy or Sole Tenancy and lacks any rights of survivorship. This means that any tenant in common can dispose of their share without the consent of the other co-tenants. After the sole owner passes away, the property is probated and subsequently distributed to their designated heirs or devisees.

Option 4: Joint Tenancy

Two or more individuals can own a piece of property through a joint tenancy, which implies that all tenants have the same interest, conveyed at the same time, and held by the same possession - known as the four unities. Furthermore, when one tenant dies, the other joint tenants automatically succeed to the deceased's share, eliminating the need for probate proceedings.
